PEMBROKE, N.Y. — A Rochester attorney accused of paying a former teen reality show star for sex got a break in court Tuesday. The charges for patronizing a prostitute against James Doyle were dismissed.

Doyle is still facing DWI, providing alcohol to a minor, and traffic charges.

Police say a drunken Doyle and 21-year-old Alicia Guastaferro, who was half naked, were caught in a car at the Pembroke Thruway Service Area last August.

Doyle meanwhile had always denied that there was any arrangement for sex with Guastaferro.

"The case is really over predicated on it's underlying facts, or the underlying allegations, or the lack thereof," said John Speranza, Doyle's attorney.

Doyle will be back in court February 12 to face the other charges which his attorney said are also serious.

Guastaferro will make her appearance before a judge December 11th.
