Family of accident victim plans to sue driver of car in fatal crash

BUFFALO, N.Y. — The family of the victim of a fatal accident last week plans to sue the estate and insurance company of the driver involved.

Last Thursday, Buffalo Police tried to to pull over a car driven by 48-year-old Issac Parker, who they believed was drunk. Police say he took off, dragging an officer. That prompted another officer to shoot at the car, hitting Parker.

He hit three street lights on Fillmore Avenue and police say one of the poles fell on 54-year-old Ida Murphy of Buffalo who was on the sidewalk. Both Parker and Murphy died at the scene.

The attorney for Murphy's family, John Elmore, says he will also bring legal action against Buffalo police if an investigation finds the officer fired at the car unnecessarily.

"If it looks as though the police officer was not justified in firing a weapon in this particular incident on this busy commercial street, then we will take the appropriate action to seek compensation," said Elmore.

A spokesperson said the city won't comment on a lawsuit that hasn't been filed yet.
