NIAGARA COUNTY, N.Y. — The former owner of 64 Pomeranians appeared in Lockport Town Court on Tuesday to face charges related to the dog breeding operation she allegedly ran in her home.

Elly Magrum, 48, pleaded not guilty to the original charge of harboring animals, as well as new charges of animal cruelty child endangerment.

The latter stems from the presence of two children in the home, which officials said smelled of urine and posed a threat to humans.

Magrum's attorney believes charges should have never been filed.

"Should they have had 64 dogs in their home? Probably not, but they did, and the bottom line is that they were all properly cared for, and fed, healthy," said her attorney, George Muscato.

Muscato will try to get the charges dismissed.
